The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has introduced an online complaint mechanism for homebuyers and allottees to report promoters demanding transfer charges beyond the prescribed limits.

Complaints can now be filed through Form-M on the UP-RERA portal, activated following the 10th amendment to the UP-RERA General Regulations, 2019.

Key Highlights of the Amendment:

Under the revised Regulation 47(c), promoters cannot execute a new or revised agreement during allotment transfers. The transfer must be recorded as an endorsement in the existing agreement, with updated records maintained by the promoter.

Prescribed Fee Limits:

  • Death of allottee (family member as successor) — Maximum processing fee: ₹1,000. Required documents: death certificate, succession certificate, and NOCs from surviving legal heirs.
  • Transfer to another family member — Maximum processing fee: ₹1,000.
  • Transfer to a non-family member — Maximum processing fee: ₹25,000.

Any charge demanded beyond these limits can be directly challenged through UP-RERA’s online complaint filing system.

This move strengthens buyer protection and brings greater accountability to the property transfer process in Uttar Pradesh.
